Terms & Conditions (SMS and Website Use)

These Terms & Conditions (“Terms”) govern your use of the American Chiropractic Billing (“ACB,” “we,” “us,” “our”) website at acbilling.com and your participation in ACB’s SMS/text messaging communications (the “SMS Service”). By using the Site or opting in to receive SMS messages from ACB, you agree to these Terms.
1) SMS Messaging Service
- Scope. ACB uses SMS strictly for transactional and service-related communications, such as responding to your inquiries, scheduling, coordination, or account/operations notices. ACB does not conduct SMS marketing campaigns.
- Consent to Text. By providing your mobile number to ACB or initiating a text conversation with us, you consent to receive SMS/MMS messages from ACB at the number you provided.
- Eligibility. You confirm you are the account holder or authorized user of the mobile number and are 18 or older (or a legally authorized business contact).
- No PHI. Do not send Protected Health Information (PHI) over SMS. Clients handle PHI only through secure, contracted channels outside of SMS.
2) Message Frequency
Messaging frequency varies based on your interactions with us (e.g., follow-ups to your questions or scheduling). You may receive multiple messages during active conversations. ACB and wireless carriers are not liable for delayed or undelivered messages.
3) Message and Data Rates
Standard message and data rates apply according to your mobile carrier plan.
We do not share SMS consent (mobile numbers or opt-in status) with third parties for their marketing purposes.
4) Opt-Out / Cancelation
To stop receiving SMS messages, reply STOP to any message. You will receive a confirmation that you have been unsubscribed. To resume messages after opting out, contact us using the details in Section 9.

6) Privacy
Your information is handled according to our Privacy Policy. By using the Site or the SMS Service, you acknowledge that you have reviewed the Privacy Policy.
7) Acceptable Use (SMS and Site)
You agree not to:
- Provide a number you are not authorized to use.
- Transmit unlawful, misleading, harmful, or abusive content.
- Attempt to disrupt, overload, or interfere with the SMS Service or the Site.
- Send PHI via SMS.
We may suspend or terminate access for violations of these Terms or applicable law.
8) Disclaimers
- Availability. The SMS Service and Site are provided “as is.” We do not guarantee uninterrupted or error-free operation.
- Carrier Liability. Wireless carriers are not liable for delayed or undelivered messages.
- No Professional Advice. Site content and SMS communications are for general business communications only and are not legal, tax, medical, or billing advice. Contracted client services are governed by separate written agreements.

10) Changes to Terms
We may update these Terms. The “Effective Date” indicates the latest revision. Continued use of the Site or SMS Service after changes means you accept the updated Terms.
11) Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. Venue lies in the state or federal courts located in Clark County, Washington.
12) Limitation of Liability
To the maximum extent permitted by law, ACB is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of the Site or the SMS Service, delays or delivery failures, or actions of carriers or third-party providers.
13) Severability; Entire Agreement
If any provision is unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ACB regarding the Site and SMS Service.
